Privacy Policy
The Open Media Foundation, a California nonprofit corporation which operates the Open Media Network (collectively "OMN") takes your privacy seriously. Please read the following to learn more about our privacy policy.
1.0 OVERVIEW. This Privacy Policy applies to the domain and subdomains of www.omn.org (the "Site"). By visiting this Site you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree with this Privacy Policy, please do not use or access our Site.
By accepting the Privacy Policy, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the terms of the OMN Terms of Use. This Privacy Policy was last updated on June 15, 2006.
2.0 INFORMATION THAT MAY BE COLLECTED. The following categories of information are intended to help clarify what information may be collected when you use the Forum and website and how that information may be used.
2.1 Personal Information
A. What is it? Personal Information is information that could allow someone to identify or contact you, such as your name, your email address, credit card information, or a username or password, or information about other personal characteristics that you may choose to provide.
B. When is it collected? During the beta launch of the Site, only producers of content are required to register for the Site and provide personal information. If and when the Site is made generally available, anyone desiring to access and use the Site may register for a membership and provide personal information. However, certain components, portions, features and/or services of the Site may only be accessible and used after a registration process requiring you to submit personal information.
Besides OMN, providers of content available on the Site ("Producers") may request your Personal Information directly. In this case the Producers' privacy policies, and not OMN's, will apply. Prior to agreeing to provide this information to a Producer, you should familiarize yourself with its privacy policies to make sure you are comfortable with the way in which your Personal Information may be used or disclosed.
C. How will this information be used? Your Personal Information will be used by OMN to communicate with you about the Site and OMN's Secure Grid Network. OMN will not disclose your Personal Information to any third party in a manner that would make it possible to personally identify you.
D. Purchases. If you purchase a product or service from us, we will request Personal Information from you on our order form. You will need to provide contact information (such as name, email, and shipping address) and financial information (such as credit card number, expiration date). We use this Personal Information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.
2.2 Log Files/Usage Information
A. What is it? As is true of most Web sites, the OMN Site gathers certain information automatically and stores it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data and information about the delivery and playback of content using the OMN software ("Usage Information").
B. When is it collected?
The OMN software collects Usage Information while you are using the OMN Secure Grid Network. This information is also collected after a piece of content has been delivered and after it has been played.
C. How will this information be used?
We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users' movements around the Site and to gather demographic information about our user base as a whole. Usage Information is also used to allow Producers to better understand what their content users are interested in.
Although it is technically possible, we do not link this automatically collected data to an individual's email address. OMN may share Usage Information that is collected on an aggregate or an individual basis with Producers or other parties, but will not disclose information in any way in which Usage Information would be personally identifiable. However, if you provide a Producer with Personal Information such as a username and/or password (see "Personal Information" above), that Producer may measure Usage Information for its specific content. Accordingly, before giving Personal Information to any Producer, we recommend that you familiarize yourself with its privacy policies to make sure you are comfortable with how your Usage Information may be used or disclosed.
2.3 Client Identifier
A. What is it? A Client Identifier (Client ID) is used to indicate a unique installation of a product, and is found in many popular software applications like media players.
B. When is it collected? You are automatically assigned a Client ID when you download the OMN software. Even if you choose not to register with OMN and decide not to provide your Personal Information, you will be assigned a Client ID. All communications between the OMN software on your computer and the servers that are part of the OMN Secure Grid Network use the Client ID to identify them.
C. How will this information be used? We use the Client ID for the following reasons:
Security: The Client ID is used to verify that the deliveries you receive through the OMN Secure Grid Network are correct. The Client ID also helps ensure that unauthorized third parties do not send incorrect or unauthorized content to other users on the OMN Secure Grid Network.
Enabling the Grid: The Client ID enables the OMN Secure Grid Network to operate more quickly by storing your deliveries on your computer and relaying them to other users on the OMN Secure Grid Network who request the same content (if you are participating in the OMN Secure Grid Network). Any such relaying or storage of content is carried out by the OMN Secure Grid Network using the Client ID. Only content originating from OMN or Producers that you have requested for delivery through the OMN Secure Grid Network may be relayed.
2.4 Diagnostic Information
A. What is it? Diagnostic Information is information that allows performance of the OMN Secure Grid Network to be monitored, including IP addresses and other information relating to the delivery of content (e.g., successful delivery rates, download times and locations, etc.).
B. When is it collected? This information is collected during transmission of content and after a delivery has been completed.
C. How will this information be used? Diagnostic Information is used to monitor performance of the OMN Secure Grid Network and to optimize its performance.
2.5 Cookies
A. What are they? "Cookies" are small files placed on your hard drive. Cookies are commonly used by web sites and applications that utilize the web in order to personalize the user experience. OMN offers certain features that are only available through the use of a cookie. We also use cookies to allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. Standing alone, cookies do not identify you personally. They merely recognize your browser.
B. When are cookies collected? The OMN software will set a cookie when you first launch it. This cookie will be automatically deleted if you do not launch the OMN software again within 30 days. A new cookie will be set if you launch the OMN software again after this 30 day period expires. You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on the Site and some of the functionality of the OMN software may not be available to you. You may also encounter cookies on certain links from the Site that are placed by Producers. We have no access to or control over these cookies. This privacy statement only covers the use of cookies by OMN.
C. How will this information be used? The OMN software uses the information stored in your cookie when you have been logged in for longer than 30 minutes. This information lets the OMN Secure Grid Network know that you are still logged in and active on the grid.
3.0 SENDING OMN MATERIALS TO A THIRD PARTY. The OMN Secure Grid Network enables you to invite third parties to download the OMN software in order to view particular pieces of content or to use the OMN software ("Share This"). This feature will ask you to provide us your name and e-mail address as well as the e-mail address of the third party to whom you are sending materials through the OMN Secure Grid Network. These addresses will not be used for marketing purposes without your prior consent.
4.0 COMMUNICATIONS FROM THE SITE
Special Offers and Updates. We will occasionally send you information on products, services, special deals, and promotions.Out of respect for your privacy, we present the option not to receive these types of communications. Please see the "Choice and Opt-out."
Service-related Announcements. We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if the OMN Secure Grid Network is temporarily suspended for maintenance, we might send you an email.
Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account. [You may opt-out of these communications. Please see "Choice and Opt-out."]
Customer Service. Based upon the personally identifiable information you provide us, we will send you a welcoming email to verify your username and password. We will also communicate with you in response to your inquiries and to manage your account.
5.0 LINKS TO OTHER SITES. The Site contains links to other websites that are not owned or controlled by OMN. Please be aware that OMN is not responsible for the privacy practices of such other websites. We encourage you to be aware when you leave our Site and to read the privacy statements of each and every website that collects personally identifiable information. This Privacy Policy applies only to information collected by this Web Site.
6.0 SECURITY. The security of your personal information is important to us. When you enter sensitive information (such as a credit card number) on our registration or order forms, we encrypt that information. We also encrypt messages relating to content requests and deliveries between your computer and the OMN Secure Grid Network. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. If you have any questions about security on our Web Site, please refer to the OMN Support Center at www.omn.org/support/.
7.0 CHANGES TO THIS STATEMENT. We may amend this Privacy Policy at any time by posting the amended terms on the Site. All amended terms shall automatically be effective 30 days after they are initially posted on the Site. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our home page.
8.0 THIRD PARTY SERVICE PROVIDERS. Third party service providers (such as hosting or storage service providers) may be technically responsible for collecting and maintaining some forms of information, but OMN contractually prohibits its own third party service providers from using such information in any manner inconsistent with this Privacy Policy. OMN also uses reasonable efforts to require its customers to take the same action with respect to their third party service providers.
9.0 OTHER THIRD PARTIES. OMN reserves the right to disclose personally identifiable information to third parties in rare special circumstances such as: in response to valid legal processes like a search warrant, subpoena, statute or court order; bankruptcy proceedings; or a merger or acquisition. In such cases, OMN will disclose personally identifiable information only to the extent reasonably necessary and will use commercially reasonable efforts to prohibit any use of the information by the third party receiving the information that is inconsistent with this Privacy Policy.
10.0 OMN.ORG WEBSITE. No individually identifiable information will be collected about a visitor to omn.org without the visitor's prior consent. Visitors to omn.org may choose to provide their e-mail address in order to receive updates and information about the OMN Secure Grid Network. If you have provided this information to OMN and you later decide you no longer wish to receive the e-mail updates, follow the directions below in the section entitled "Unsubscribing".
11.0 CONTROL OF YOUR PASSWORD. You are responsible for all actions taken with your user ID and password, including fees charged to your account. Therefore OMN recommends that you not disclose your password to any third parties. If you choose to share your user ID and password or your personal information with Producers or other third parties, you are responsible for all actions taken with your account and therefore you should review that Producer's or third party's privacy policy. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.
12.0 UPDATING YOUR INFORMATION. OMN strives to keep your personally identifiable information accurate. After the beta period, if and when OMN makes the Site generally available, OMN will provide a means for you to view, update or correct any personal information you have provided. To review or change your information start the OMN software, click on Tools, select Registration, update your information and click on Submit.
13.0 UNSUBSCRIBING. After the beta period, if and when OMN makes the Site generally available, if you have become a member or otherwise provided OMN with personal information, OMN will provide a means for you to request deactivation of your account, contact information, and any financial information from our active databases. Such information will be deactivated as soon as reasonably possible in accordance with our deactivation policy and applicable law. However, we will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our Terms of Use. Further, such prior information is never completely removed from our databases due to technical and legal constraints, including stored "back up" systems. Therefore, you should not expect that all of your personally identifiable information would be completely removed from our databases in response to your requests. Additionally, if you provide Personal Information directly to a Producer either to access content or upon request from a Producer, you will need to contact that Producer directly in order to have this Personal Information removed.
14.0 COLLECTING INFORMATION FROM CHILDREN. Personal information is not knowingly collected from children under the age of thirteen (13) and we ask that minors (under the age of 13) do not submit any personal information to OMN.
